インターネットを通じて映像や音楽を共有するソフト「ウィニー」を開発し、著作権法違反の幇助（ほうじょ）罪に問われた元東京大大学院助手・金子勇被告（４１）の上告審で、最高裁第三小法廷（岡部喜代子裁判長）は、有罪を求めていた検察側の上告を棄却する決定をした。１９日付。無罪とした二審判決が確定する。
金子元助手は２００２年５月、自ら開発したウィニーをインターネットで公開。０３年９月、松山市の無職少年（当時１９）ら２人＝著作権法違反の罪で有罪＝がウィニーでゲームソフトや映画をダウンロードし、不特定多数へ送信できるように手助けした、として起訴された。
０６年１２月の一審・京都地裁判決は「著作権者の利益が侵害されるのを認識しながら、ウィニーの提供を続けていた」として罰金１５０万円の有罪とした。一方、０９年１０月の二審・大阪高裁判決は「著作権侵害が起こると認識していたことは認められるが、ソフトを提供する際、違法行為を勧めたわけではない」として、無罪としていた。
